PARTICIPATION WAIVER, RELEASE OF LIABILITY & TERMS AND CONDITIONS PLEASE READ CAREFULLY BEFORE SIGNING. THIS AGREEMENT AFFECTS IMPORTANT LEGAL RIGHTS. This Participation Waiver, Release of Liability, Assumption of Risk, and Terms and Conditions Agreement ("Agreement") applies to participation in activities, programs, events, and services offered, organized, or operated by Heyen Hoops ("Heyen Hoops"). By signing this Agreement, the participant, or the participant's parent or legal guardian if under 18 years of age, acknowledges and agrees to the following terms. 1. SCOPE OF PARTICIPATION This Agreement applies to all Heyen Hoops activities, including but not limited to: * Individual, small-group, and team basketball training * Heyen Hoops Academy practices, games, tournaments, and team activities * Basketball camps, clinics, and special events * Shooting machine reservations and workouts * Open gyms, pickup basketball, and recreational activities * Basketball leagues, competitions, and tournaments * Strength, conditioning, agility, and athletic development activities * Private court rentals and other authorized facility activities * Other programs, services, and activities conducted by or through Heyen Hoops This Agreement applies to participation at Heyen Hoops facilities and at other locations where Heyen Hoops conducts or organizes activities. 2. ACKNOWLEDGMENT AND ASSUMPTION OF RISK I understand that basketball and other athletic activities involve inherent risks, including serious injury, permanent disability, paralysis, and death. These risks may include, but are not limited to: * Collisions or physical contact with other participants * Falls, slips, trips, or loss of balance * Sprains, strains, fractures, concussions, and other injuries * Injuries involving basketballs, hoops, shooting machines, or other equipment * Injuries arising from physical exertion, fatigue, dehydration, or overexertion * Unsafe or unexpected actions by other participants * Equipment malfunction or unexpected facility conditions I understand that injuries may occur even when reasonable safety precautions are followed. I voluntarily accept and assume all inherent and ordinary risks associated with participation in Heyen Hoops activities, including the possibility of serious injury or death. I understand that Heyen Hoops cannot guarantee the safety of any participant or prevent every injury. 3. RELEASE OF LIABILITY AND WAIVER OF CLAIMS To the fullest extent permitted by Illinois law, I voluntarily release and discharge Heyen Hoops, its owners, officers, employees, coaches, trainers, contractors, volunteers, agents, representatives, and affiliated entities (collectively, the "Released Parties") from claims arising from the ordinary risks of participation in Heyen Hoops activities. To the extent enforceable under applicable law, this release includes claims alleging ordinary negligence by the Released Parties. This Agreement does not release claims that cannot legally be waived, including claims involving willful or wanton misconduct or other conduct for which liability cannot be excluded under Illinois law. I understand that this release may limit my ability to recover damages for injuries, losses, or other harm associated with participation. For participants under 18, the parent or legal guardian signs this Agreement on their own behalf and provides consent for the minor's participation. Any attempted release of the minor's independent legal claims applies only to the extent permitted by Illinois law. 4. PARTICIPANT HEALTH AND MEDICAL AUTHORIZATION I acknowledge that participation in basketball and athletic activities requires an appropriate level of physical health and fitness. I agree that: * Participants should not participate while experiencing symptoms that could make physical activity unsafe. * Participants must inform Heyen Hoops staff of any injury, medical restriction, or condition that may affect safe participation. * Participants must follow reasonable safety instructions from coaches and staff. * Participants should immediately stop participating and notify staff if they experience pain, dizziness, difficulty breathing, or other concerning symptoms. Emergency Medical Authorization If a participant experiences an injury or medical emergency, I authorize Heyen Hoops staff to contact emergency medical services and seek appropriate emergency medical assistance when reasonably necessary. I understand that Heyen Hoops personnel are not required to provide medical treatment beyond their training or qualifications. I accept financial responsibility for medical treatment, transportation, and related expenses incurred on behalf of the participant. For minor participants, I authorize emergency medical assistance when a parent or guardian cannot be reached promptly. 5. PARTICIPANT BEHAVIOR AND FACILITY RULES All participants are expected to demonstrate respect, sportsmanship, and appropriate behavior. Participants must: * Follow instructions from Heyen Hoops coaches and staff. * Treat other athletes, coaches, officials, and guests respectfully. * Refrain from bullying, harassment, threats, fighting, or aggressive behavior. * Use equipment and facilities appropriately. * Follow posted facility rules and safety procedures. * Avoid behavior that endangers themselves or others. Heyen Hoops reserves the right to suspend or remove any participant whose behavior is unsafe, disruptive, disrespectful, or otherwise inappropriate. Removal for serious misconduct may result in forfeiture of program fees, subject to applicable law. 6. EQUIPMENT USE AND PROPERTY DAMAGE Participants agree to use all Heyen Hoops equipment and facilities responsibly. This includes basketballs, shooting machines, hoops, training equipment, furniture, fixtures, and other facility property. Participants may not: * Misuse, intentionally damage, or tamper with equipment. * Operate equipment without authorization. * Enter restricted areas without permission. * Engage in activities that could reasonably damage the facility or endanger others. Participants, and parents or guardians where legally responsible, may be held financially responsible for the reasonable cost of repairing or replacing property damaged through intentional misconduct, recklessness, or negligence, to the extent permitted by law. Normal wear and tear is excluded. Heyen Hoops is not responsible for lost, stolen, or damaged personal belongings except where responsibility is imposed by applicable law. 7. SHOOTING MACHINE SAFETY Participants using automated basketball shooting machines must follow all posted instructions and staff directions. Participants agree to: * Use shooting machines only during authorized reservations or supervised sessions. * Follow all equipment safety instructions. * Keep hands, feet, and other objects away from moving parts. * Avoid adjusting, repairing, or tampering with equipment without staff authorization. * Immediately report malfunctions or unsafe conditions. * Stop using equipment if it appears damaged or unsafe. Parents and guardians are responsible for ensuring that minor participants understand and comply with applicable equipment rules. Heyen Hoops reserves the right to restrict or revoke equipment access for unsafe or improper use. 8. PARENT, GUARDIAN, AND SPECTATOR RESPONSIBILITIES Parents, guardians, and spectators are expected to support a positive and respectful environment. They agree to: * Treat coaches, officials, staff, athletes, and other families respectfully. * Refrain from abusive, threatening, or disruptive behavior. * Follow facility rules and staff instructions. * Supervise children who are not actively participating in a supervised program. * Respect designated participant-only and restricted areas. Heyen Hoops reserves the right to remove spectators or guests who violate facility rules. Unless expressly agreed otherwise, Heyen Hoops does not provide childcare or supervision before or after scheduled activities. Parents and guardians are responsible for arranging timely drop-off and pickup of minor participants. 9. REGISTRATION, PAYMENTS, AND CANCELLATIONS Registration and payment requirements vary by program, membership, or service. By registering, participants and purchasers agree to the pricing, payment schedule, cancellation requirements, and other financial terms disclosed at the time of purchase. General Payment Policies * Payment may be required before participation. * Program registrations are subject to availability. * Memberships and recurring subscriptions renew according to the terms disclosed during enrollment. * Cancellation of a recurring membership must follow the applicable membership agreement. * Unused sessions, credits, and packages are subject to the expiration terms disclosed at purchase. * Missed sessions do not automatically qualify for refunds or replacement sessions. * Approved refunds, if applicable, will be processed according to the relevant program policy and applicable law. Program Changes Heyen Hoops reserves the right to modify schedules, instructors, program formats, or locations when reasonably necessary. If Heyen Hoops cancels a paid program or cannot provide a purchased service, participants will be offered an appropriate alternative, credit, or refund consistent with applicable law and the circumstances. 10. PHOTOGRAPHY, VIDEO, AND MEDIA CONSENT Heyen Hoops may photograph or record training sessions, practices, games, camps, clinics, and other activities for instructional, educational, operational, and promotional purposes. Photographs and recordings may be used on the Heyen Hoops website, social media accounts, marketing materials, and other business communications. Media permission is optional and is not required for participation. Participants or parents/guardians may grant or decline promotional media permission through a separate consent selection. Heyen Hoops will respect a declined promotional media authorization and will make reasonable efforts to avoid using identifiable images of participants who have not provided permission. Instructional or operational recordings will be handled separately from promotional media use. 11. PERSONAL INFORMATION AND COMMUNICATIONS Heyen Hoops collects participant and customer information as reasonably necessary to provide services, manage registrations, process payments, communicate schedules, and operate programs. Information may be processed through authorized service providers, including CoachIQ and payment-processing platforms. Heyen Hoops will handle personal information in accordance with applicable privacy laws and its published privacy practices. By registering, participants and parents/guardians consent to receiving necessary service-related communications regarding scheduling, registrations, payments, safety, and program updates. Promotional text messages and other marketing communications requiring separate consent will be handled through an appropriate opt-in process. 12. PROGRAM MATERIALS AND INTELLECTUAL PROPERTY Training programs, instructional videos, curriculum, drills, written materials, and other original Heyen Hoops content remain the property of Heyen Hoops or their respective rights holders. Participants may not reproduce, sell, redistribute, or commercially use proprietary Heyen Hoops materials without written permission. 13. COMMUNICABLE ILLNESS I understand that participating in group activities may involve exposure to contagious illnesses. Participants agree not to attend activities when experiencing symptoms of a contagious illness that could reasonably put others at risk. Heyen Hoops may ask participants exhibiting concerning symptoms to leave an activity. 14. APPLICABLE LAW AND SEVERABILITY This Agreement shall be governed by the laws of the State of Illinois. If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall continue in effect to the extent permitted by law. Nothing in this Agreement is intended to waive rights that cannot legally be waived. 15. DURATION OF AGREEMENT This Agreement applies to the participant's current and future participation in Heyen Hoops activities unless replaced by a subsequent agreement or otherwise terminated in accordance with applicable law. Heyen Hoops may require participants to review and sign an updated agreement periodically or when material changes occur. 16. ACKNOWLEDGMENT AND CONSENT BY SIGNING BELOW, I ACKNOWLEDGE THAT: 1. I have carefully read and understand this Agreement. 2. I understand that participation in basketball and athletic activities involves inherent risks, including serious injury or death. 3. I voluntarily accept the risks associated with participation. 4. I understand that this Agreement contains a release of liability that may affect important legal rights. 5. I agree to follow Heyen Hoops facility rules, safety requirements, and participation policies. 6. I understand the applicable registration, payment, and cancellation policies. 7. I am signing voluntarily and have had the opportunity to ask questions before signing. FOR PARTICIPANTS UNDER 18 YEARS OF AGE: I certify that I am the participant's parent or legal guardian, have the legal authority to provide consent, and authorize the minor participant to participate in Heyen Hoops activities. I acknowledge the risks associated with my child's participation and agree to the parent/guardian responsibilities outlined in this Agreement.
